These terms govern your use of SellMyStuff (“the platform”), a second-hand goods marketplace operating in Kenya. By creating an account you agree to them. If you do not agree, do not use the platform.
1. What SellMyStuff is — and is not
SellMyStuff is a neutral marketplace facilitator. We connect buyers and sellers. We do not own, hold, inspect, test, or guarantee any item listed on the platform.
Specifically, SellMyStuff does not:
- own, store, or inspect any listed goods;
- guarantee that any item is as described, functional, or legally owned by the seller;
- guarantee payment between a buyer and a seller;
- mediate or arbitrate financial disputes between users;
- provide delivery, collection, or logistics of any kind.
Every transaction is concluded directly between the buyer and the seller, in person. You are responsible for satisfying yourself as to the condition, ownership and legality of any item before paying for it.
2. Eligibility and accounts
- You must be at least 18 years old to hold an account.
- You must provide accurate information and keep it current.
- You are responsible for all activity under your account. Do not share your login credentials or one-time passcodes with anyone — including anyone claiming to be from SellMyStuff. We will never ask you for your OTP.
- One person may not operate multiple accounts to evade limits, fees, or suspension.
3. Seller verification
To list an item you must complete identity verification by submitting a Kenyan National ID document. Verification is reviewed by our team before your first listing goes live. We may decline or revoke verification at our discretion, including where a document is unreadable, appears altered, or does not match the account holder.

4. Fees
All fees are payable in Kenyan Shillings via M-Pesa and are stated inclusive of tax.
- Seller listing fee — 5% of the asking price, capped at KES 1,000. Payable when you publish a listing. A listing becomes visible only once this fee is paid.
- Buyer access subscription — KES 250 for 14 days. Required to place bids, reserve items, message sellers, and unlock seller contact details. Renewing before your current period ends extends it rather than replacing it.
- Listing boosts — from KES 200 to KES 500 depending on placement, for a 7-day promotion period beginning when payment is confirmed.
- Verification badges — KES 500 per badge.
Fees are non-refundable, including where an item does not sell, a listing is removed for breaching these terms, or a subscription goes unused. The listing fee pays for publication, not for a sale.
5. Bidding
A bid placed on an auction-enabled listing is an offer to buy at that price. Sellers are not obliged to accept any bid. When a seller accepts your bid, you are expected to complete the purchase in good faith. Repeatedly bidding and withdrawing may result in suspension.
6. Reserve deposits
Reserving an item requires a deposit of 20% of the asking price, paid via M-Pesa. A reserve holds the item exclusively for you for 5 days, during which no other buyer can reserve it.
- If you complete the purchase — the deposit forms part of the price you agreed with the seller. Settle the balance directly with them.
- If you withdraw without valid cause — the deposit is forfeited. This is what makes a reserve meaningful to a seller who has taken their item off the market for five days.
- If the seller cancels or sells to someone else — your deposit is returned.
- If the reserve expires unused — the item returns to the marketplace and the deposit is handled according to the reason it lapsed.
A seller may override an active reserve to complete a sale. Where that happens, the reserving buyer's deposit is returned.
7. Prohibited items and conduct
You may not list, or use the platform to trade:
- stolen goods, or goods you do not own or have the right to sell;
- counterfeit or replica branded goods;
- firearms, ammunition, explosives, or weapons;
- drugs, controlled substances, prescription medicines, or drug paraphernalia;
- live animals, human remains, or bodily fluids;
- government documents, identity documents, licences, or certificates;
- adult material, or any item whose sale is restricted under Kenyan law;
- recalled goods, or items that are unsafe in their advertised condition.
You also may not:
- misrepresent an item's condition, age, provenance or functionality;
- arrange payment off-platform in order to avoid fees, then use the platform's reach to find the buyer;
- harass, threaten, or defraud another user;
- scrape, automate, or otherwise access the platform other than through its interface.
8. Moderation, suspension and removal
We may remove any listing, and suspend or ban any account, where we reasonably believe these terms have been breached — including on the basis of fraud reports from other users. Where an account is suspended, its active listings are withdrawn from the marketplace. Paid fees are not refunded on suspension for a breach.
9. Ratings and reviews
Ratings may only be left by a buyer with a completed transaction record on the platform. You may not solicit, trade, or pay for ratings, and you may not use a rating to threaten a seller into a concession.
10. Limitation of liability
To the fullest extent permitted by Kenyan law, SellMyStuff is not liable for any loss, damage, injury or cost arising from a transaction between users, from the condition or legality of any item, from a meeting arranged through the platform, or from any user's conduct. Our total liability to you in any circumstance is limited to the fees you paid us in the 3 months preceding the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act and the Data Protection Act 2019.
11. Changes to these terms
We may update these terms. Where a change materially affects your rights we will give notice through the platform. Continued use after a change takes effect constitutes acceptance.
12. Governing law
These terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have exclusive jurisdiction over any dispute arising from them.
